These Terms of Service ("Terms") govern your access to and use of the StackPick platform, including all content, scores, data, tools, and services provided through https://stackpick.io (the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. About StackPick
StackPick operates as an independent software discovery and comparison platform. The Platform provides analytical content, including EASE and LEVERAGE scores, visualizations, and written analysis intended to help users find software that fits their needs.
StackPick does not provide professional advice and does not act as a broker, reseller, procurement agent, or certification authority.
2. Eligibility & Access
You may use the Platform if:
- You are at least 18 years old
- You have the legal capacity to enter into binding agreements
- You comply with these Terms and all applicable laws
StackPick reserves the right to suspend or terminate access to the Platform at any time, with or without notice, for violations of these Terms or for operational, legal, or security reasons.
3. Nature of Content
All content published on StackPick, including but not limited to scores, rankings, and commentary:
- Represents analytical assessments and expressions of opinion, not statements of objective or verifiable fact
- Is based on disclosed methodologies and aggregated data sources
- Reflects relative, comparative evaluations within defined software categories
No reasonable user should interpret EASE scores, LEVERAGE scores, or visualizations as guarantees, certifications, or statements of absolute fact.
4. No Professional or Commercial Advice
The Platform is provided for informational and research purposes only.
StackPick does not provide:
- Legal advice
- Financial or investment advice
- Procurement or vendor-selection advice
- Security, compliance, or performance certifications
You remain solely responsible for any decisions made based on information obtained from the Platform.
5. Editorial Independence & Affiliate Model
StackPick operates with strict editorial independence.
- Scores and rankings cannot be purchased, altered, or suppressed through payment
- We earn revenue through affiliate referrals when users find and adopt software
- This model aligns our incentives with user success, not vendor payments
- Editorial decisions remain final, subject only to verified factual corrections
Differences in scoring outcomes reflect differences in software design and user experience, not vendor identity, size, or market position.
6. User Accounts & Profile Claims
Certain features may require account creation, including claiming a vendor profile or submitting verified reviews.
You agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your account credentials
- Be responsible for all activity under your account
StackPick may revoke account privileges if false information, impersonation, or abuse is detected.
7. User Contributions & Conduct
Users may submit reviews, responses, or other content ("User Contributions") subject to moderation.
You agree not to submit content that:
- Is false, misleading, or defamatory
- Contains personal attacks or non-technical grievances
- Infringes intellectual property rights
- Is intended to manipulate scores
- Constitutes spam, harassment, or coordinated interference
StackPick reserves the right to moderate, remove, or refuse User Contributions at its sole discretion.
8. Right of Reply & Corrections
Software vendors may:
- Claim their official profile
- Submit public responses to evaluations or scores
- Request corrections for outdated or inaccurate technical information
StackPick reserves final editorial judgment regarding all published content.
9. Intellectual Property & Trademarks
All Platform content, including but not limited to:
- StackPick name and logo
- Methodologies, text, visualizations, and trademarks
is owned by StackPick or its licensors and is protected by applicable intellectual property laws.
All third-party trademarks, logos, and product names are used solely for identification and analysis purposes. Their use does not imply endorsement, sponsorship, or affiliation.
Limited License
Non-commercial sharing of visualizations is permitted under the Creative Commons BY-NC-SA license, with proper attribution.
10. Acceptable Use
You agree not to:
- Scrape or harvest the Platform at scale without authorization
- Reverse engineer or attempt to replicate scoring systems
- Interfere with Platform operation or security
- Use the Platform for competitive sabotage, disinformation, or manipulation
Automated access may be restricted or rate-limited.
11. Third-Party Content & References
The Platform may reference, analyze, or discuss third-party software and services.
StackPick is not responsible for:
- The accuracy of third-party content
- External websites or services
- Changes to third-party products occurring after publication
12. Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.
StackPick disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law:
StackPick shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to use of the Platform, including loss of data, revenue, reputation, or business opportunity.
Total liability, if any, shall not exceed the amount paid by the user to StackPick in the preceding twelve (12) months.
14. Indemnification
You agree to indemnify and hold harmless StackPick from claims, damages, losses, and expenses arising from:
- Your use of the Platform
- Your User Contributions
- Your violation of these Terms
15. Termination
StackPick may suspend or terminate access to the Platform at any time.
Upon termination, provisions relating to intellectual property, disclaimers, limitation of liability, and indemnification shall survive.
16. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction of StackPick's operating entity, without regard to conflict-of-law principles.
17. Changes to These Terms
StackPick may update these Terms periodically.
Continued use of the Platform after changes constitutes acceptance of the revised Terms.
